116P Mediation Midterm Instructions Thus far in the semester, we’ve spent time learning the theory of particular concepts as they apply to mediation, and conflict resolution. Some theories are best practice, some are ‘absolutes,’ and still others are user discretion. When possible, either in class, or in your group work, you’ve seen many of these theories applied to role play scenarios. This mediation midterm tests your ability to hear about a conflict scenario, including the personalities, and the substance of the conflict itself, and from these, to identify what concepts that you’ve learned thus far are likely applicable to the scenario. This exercise is called ‘issue spotting.’ When you issue spot, you are telling the tester that you’re capable not only of performing well on a summative assessment, which tests the ability to regurgitate information learned about a subject, but you likewise have the ability to understand and explain the connection between the concept learned, and its appropriate application. Read through the midterm scenarios presented, and identify: (1) what concepts plausibly apply to the given scenario; (2) what the concepts mean (describe / define the concept); and lastly (3) explains how you would handle the situation, as a prospective mediator, given the circumstances. In explaining this last item, be sure to spend a good deal of your time explaining your rationalization, or reasoning. I’m less concerned that you reach a conclusion, as such; but rather, am much more concerned with the your cognitive process.
